Divorce, Judicial Separation and Dissolution of Civil Partnerships

To obtain a divorce you must prove to the Court that your marriage has irretrievably broken down and to do this you can rely upon anyone of five different grounds for divorce. If you seek Judicial Separation you rely on the same grounds but do not have to prove irretrievable breakdown of marriage. You must remember however that there is a restriction on seeking divorce or judicial separation during the first year of your marriage.

The five grounds for divorce or judicial separation require you to prove that your spouse has:-

a.committed adultery; or
b.behaved in a way that makes it unreasonable for you to have to continue to live with them; or
c.deserted you for more than two years; or
d.lived apart from you for two years or more and consents to the divorce or judicial separation; or
e.lived apart from you for five years or more.

In most cases an undefended divorce takes approximately 5 to 6 months to complete and usually will not require you to attend Court.

Dissolution of Civil Partnerships

The grounds and procedure for dissolving civil partnerships are the same as for divorce except that adultery is excluded.
